Rock on! Get that new car, and don't settle for anything less!! If the insurance company doesn't cooperate, file suit against that company directly... Trust me, they will settle out of court for a brand new CR-Z, any variant, color, etc you want!
And make sure the dealer adds any factory goodies you had or want BEFORE the purchase is made!!

We finally got the police report in, and it's an interesting read. It was indeed confirmed that I was nowhere near at fault. Not only that, but the bloke that hit me was under the influence (just as I thought), though not of alcohol, but of some pretty heavy meds. This explains why he was so "out-of-it" despite it not being a major crash (he couldn't even put words together). The cops could scarcely manage to interview him. He basically passed out at the wheel. If my poor Z hadn't been in his way, he likely would've kept driving right into traffic. Scary.

It gets better. He was also under probation and not even legally allowed to operate a motor vehicle at the time. This puts his employer (as you know, he was driving his company's van) in a right pickle. Their insurance company's tone did a complete 360, and now they're being much more accommodating. They are more or less at my mercy now, so to speak.

They've already set up the rental car for me, and I'm going to push harder than ever now for a brand new CR-Z instead of just a fix.

So yeah, finally some good news. It's going to be a little while yet before I'm reunited with my car, but at least I'm holding all the cards now.

Small update for anyone interested, it was declared that the car was not totalled, so they're going to fix it. I'm not disappointed though, because I trust that the dealer will do a good job, and it will be nice to get back the car I "bonded" with, lol. The tow truck managed to do $250 worth of damage to my front end, so I'm gonna fight to have the insurance pay for that as well.

However, a crashed car is a crashed car, so I am now in talks with an attorney to see if I can get reimbursed for the diminished value of the car. He says the case looks good, as it's so cut-and-dried that I was faultlessly rear-ended by someone driving whilst breaking several laws. The other guys don't have much of a leg to stand on. But I'm not going to count chickens before they hatch, so I'll wait to see what unfolds.

So in case anyone's curious, I got the call from the body shop, and my Z will be ready to pick up on the 29th, and I'm excited to see her again.

Insurance said they won't pay for the tow-truck damage, and not even my attorney could convince them, so it is what it is. However, from what I was told, the damage is cosmetic, and it's under the car so it's only visible if you get beneath it. So I might just leave it as is. If it's something really noticeable, then I'll just pay the $250 and be done with it.

Glad to here it's almost back to you. How are things going with the diminished value suit?

It's still up in the air for now, but so far everything seems to be going good. The lawyer told us to just sit tight for now while he gets everything rolling, so hopefully when the time comes he'll have some good news.

Indeed, way too long for my tastes. Apparently the biggest hold-up was waiting for the parts to arrive. In any case I'd rather they take their time and make sure everything's perfect, but yeah it's been a right drag not being able to enjoy my new car all this time. I'm just glad it'll be back home in just a few more days.

It might sound silly, but I've actually had dreams about my car in the past few days, so I must really be missing it! XD

Aaaaaaand.... She's back with a vengeance.

Repair job was perfect, looks like nothing ever happened to it. They even detailed it for me. Feels really good to finally have my car back home where it belongs.

There were two small issues though. The little plastic bit that covers the key slot by the shifter was missing. Turns out it was the towing company that pulled it off and just tossed it aside. Luckily the nice chap who helped me at the dealer found it under the passenger's side rug. Then the TPMS warning came on while driving. The front driver's side tyre was indeed a little low, so they filled it. The light still comes on though. I don't know if I should wait for it to shut off on its own, or have it reset at the dealer.
